Practical Law Canada Competition

This Featured Update discusses recent criminal competition law enforcement developments. These include the Competition Bureau’s further enhanced bid-rigging enforcement efforts, upcoming updates to its Immunity and Leniency Programs and new partnerships with other law enforcement agencies. Also discussed are several recent important criminal competition law related cases.

Practical Law Canada Competition

Criminal competition law enforcement remains a top Competition Bureau (Bureau) priority. While criminal enforcement, including in relation to the conspiracy and bid-rigging provisions of the Competition Act, R.S.C. 1985, c. C-34 (Competition Act), have been Bureau priorities for some years, it continues to strengthen and refine its enforcement approach.

In this regard, the Bureau has recently:

1. Further strengthened its bid-rigging enforcement efforts.

2. Indicated the timing and some details for its plan to update its Immunity and Leniency programs.

3. Expanded its partnerships with other law enforcement agencies.

4. Cooperated in cross-border criminal investigations.

5. Announced that it will host the 2017 International Competition Network (ICN) Cartel Workshop in Ottawa.

Several important criminal competition law related cases have also recently been decided, including in relation to the limitation periods for Competition Act private actions and the required elements for section 90.1 of the Competition Act (the civil agreements section).
